I found Jessica Monsell's story here about Amazon trying to steal Richard Thripp's $453 Amazon gift card balance upon closing his account, and they are now trying to do the same with me! My gift card balance of $405.00!

    Source: http://elliott.org/case-dismissed-2...eatment-after-closing-his-account-and-us-too/

I only had one order that needed to be refunded in the past, and I tried placing an order recently only to have my account shutdown by Amazon. I mentioned that nowhere in their terms of service does it state that they are allowed to seize and keep customer gift card balances. They keep sending this in response:

"As mentioned in our Conditions of Use: “Amazon reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.”"

Again, the "Account Specialists" are unable to cite and provide a TOS that I agreed to which suggests that they can keep (Steal) gift card balances from its customers! If they don't wish to do business with me it is a mutual feeling. However, I would like to retain what is rightfully mine - $405.00!

I've sent four (4) emails that state that they can reserve the right to not allow me to shop on Amazon, however I can receive a check of what I'm owed instead. Albeit, just as Jessica Monsell's article headline states - they have given me the silent treatment.

I ask that you please help me with getting in contact with someone and getting this story out like you have with Richard Thripp. Any email conversations that we've had or information that you'd like for me to provide I would happily oblige.

    Regards,

    Louis Morgan

Amazon's general number is 888-280-3321. I have always recieved professional service calling their support people. Additionally, if you go to the Amazon contact us page you do not have to be signed in or have an account to go through the menu options and enter your number for an immediate call back.

In this case it seems as though a phone call may be easier than emails.

By the Way, when you talk to them or email them, make sure are polite. No talk of scamming, stealing, beware, etc. Don't be adversarial.

I would write to the Attorney General in the state Amazon is located in. While Jessica couldn't get them to do anything, if enough consumers file complaints, perhaps the AG will start looking into Amazons practice. There are times such as this when a company won't even deal with our trouble shooters and it seems there is really nothing more we can do.

Neil, since most states have really gone after Amazon for sales taxes that their residents try to avoid, Amazon is slowly moving some sort of presense into almost every state. In my state they supposedly built some type of computer center and so now they collect sales taxes from me. In any event, since the company now has an operation of some sort within almost every state, Louis should be able to contact the AG in his own state.

Is there a concern a to where and how the Amerizon Gift Card balance came from? Did they tell you why your account was closed in writing? It matters as to how we proceed. Would be very interested to see the letter or email outlining why. Please post after removing your Acct # and other identifying details.

Ok I wonder. Did you play with any manufactured spend on amazon payments or local register? Be honest why was your account frozen?

Didn't we have a guy here this happened to that was playing the system? This is a very familiar thread butbI distinctly remember the other guy admitted he was doing something he shouldn't have.

@Louis Morgan I have always found Amazon a piece of cake to deal with. It usually takes a phone call. For us to help you, could you provide more details? What were the credits from, etc?

Freaking out and going all Richard Thripp will just overcomplicate something that may be very simple. Leave the emotion out and just state the facts.

What reason did Amazon give you for shutting your account down?

An Amazon Account Specialist said that since I am no longer a user their customer service can no longer assist me. Only Account Specialists can, and they have given me the silent treatment.

I have written the Better Business Bureau and I've received confirmation that they have now contacted Amazon with my inquiry. Next is my states Attorney General. Thank you for the tip.

Your comments appear to have a presumptuous tone. Guilty until proven innocent with you, it seems.

I am in contact with Mr. Thripp. Thank you for the lead, though.

Absolutely not. Nothing funny like the money laundering scheme that the above user insinuated. It was merely a balance from my sole and only refund. They told me why my account was closed, but didn't quite explain why at the same time. I've read numerous stories online and it's the same canned, generic response that they've given everyone else.

Here is a bit of our exchange:

    Hello,

We have closed this account because our records show that we closed another account of yours for not meeting the terms of our Conditions of Use agreement. When we close your account for violating the terms of an agreement, you cannot open a new account or use another account to place orders on our site.

If you had open orders on this account, those orders were canceled when we closed the account.

Any digital content you purchased with this account is still available to you. To access the content, click the “Manage Your Content and Devices” link on the Your Account menu on Amazon.com (www.amazon.com/manageyourkindle).

If you would like to appeal this decision, please reply to this email to reach an Account Specialist. Our Customer Service team can only confirm that we sent this message and help you with technical issues. They cannot reverse this decision or share more details on this matter.

    Sincerely,

    Account Specialist

    ----------------------------------------

I *absolutely* appeal this decision. Why is my account being closed? This doesn't make any sense whatsoever! First you freeze my account and tell me I needed to fax and confirm my billing information, which I did. Then you state: "You can now access your account and place orders." Now when I place an order, my entire account gets closed? What heck man, what's going on?

    ----------------------------------------

    Hello,

As informed earlier, we have closed this account because our records show that we closed another account of yours for not meeting the terms of our Conditions of Use agreement. When we close your account for violating the terms of an agreement, you cannot open a new account or use another account to place orders on our site.

After a thorough review, we have decided not to restore your full access to this account. You will not be able to place orders with our site.

As your Amazon.com account is closed, and you are no longer able to shop in our store.

If you were to open a new account, it would also be closed.

If you have any digital content on this account, you can access the content from the “Manage Your Content and Devices” link on the Your Account menu on Amazon.com (www.amazon.com/manageyourkindle).

We are unable to provide information about additional accounts or resources we have used to identify the link between accounts.

However, your account will remain closed.

Please do not contact Amazon's Customer Service department, as they will no longer be able to assist you. If you require additional assistance, or have any concerns, you may contact us directly at cis@amazon.com.

    Best regards,

    Account Specialist
    Amazon.com

    ----------------------------------------

That is simply a lie. I do not have another account. Not to mention I have a $405 balance on my Amazon account. If you are going to close my account I DEMAND that you write me a check for that amount. You will NOT just take my money. I will contact the attorney general and the Better Business Bureau if you do not either 1) re-open my account and allow me to spend my funds, or 2) you write me a check of $405. It is your choice.

    ----------------------------------------

    Hello,

Thank you for writing to us.

I understand your concern regarding cancellation of your Amazon.com account.

After a thorough review, we have decided not to restore your full access to this account. You will not be able to place orders with our site.

We closely examined your account, your order history and your related accounts to ensure that any decision regarding your account was made according to our policies.

As mentioned in our Conditions of Use: “Amazon reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.”

You can review our Conditions of Use in their entirety here:

    www.amazon.com/conditionsofuse

Please know, any attempt to open a new account will result in the same action.

Regarding your gift card funds ---

We closed your account because you reported an unusual number of problems with your orders. As a result, your unused gift card balance is no longer available.

If you require any further assistance, please contact us directly at cis@amazon.com.

    Best regards,

    Account Specialist
    Amazon.com

    ----------------------------------------

"We closed your account because you reported an unusual number of problems with your orders."

See, all that stuff about "another account linked to you violated our TOS" was bullcrap. I have no other account. Now, please explain in further detail what "unusual number of problems with your orders" means, because I only placed ONE (1) order before this and had an issue. How is this an "unusual number of problems"? I mean, seriously? I ask that you please reconsider your stance, you are making a mistake.

"As a result, your unused gift card balance is no longer available."

Now this is an absolutely unacceptable business practice, and you should absolutely be ashamed.

A terms of service agreement is legal binding. Show me - in detailed writing - a TOS that we agreed to upon doing business which states you are permitted to keep and not refund gift card balances upon closing our accounts. Thank you.

    Regards,

    Mr. Morgan

We closed your account because you reported an unusual number of problems with your orders in multiple accounts. As a result, your unused gift card balance is no longer available.

    Hello,

I apologize for using terms like "bullcrap" in my last message. This has just been very frustrating with the whole multiple billing statement requests which I provided and now this, and potentially losing $405. I realize you're just doing your job, it's just on my end it's been quite draining, too.

Anyway. I have no idea what you're referring to by multiple accounts as this is my only one. I only had one transaction that had an issue. I've shopped with Ebay for about 14 years and have had zero transaction issues. You are making a mistake. Can you please reconsider re-opening my account?

    Regards,

    Louis

    ----------------------------------------

I would like to escalate this issue to Amazon’s Executive Customer Relations team. As far as I'm aware I cannot contact them, however YOU can forward the information.

According to www.elliott.org , Richard Thripp's account was also closed with a $453 gift card balance and was initially not granted to receive his money. However, after MONTHS of several complaints to the BBB, two state attorney generals, and reaching out to websites to broadcast your fraudulent activity - he was granted that his account be un-banned - allowing him to spend his gift card balance - then re-banned.

    Source: http://elliott.org/case-dismissed-2...eatment-after-closing-his-account-and-us-too/

I ask for the same resolution. Temporarily un-ban my account and allow me to spend my gift card balance, then re-ban my account.

    Regards,

    Louis Morgan

Well, this isn't the first event where Amazon attempted to steal $400+ of a customers money, and I'm sure won't be the last. I have provided this information above. Thanks for responding.

The information is provided above. Thank you for responding.

While most people here do not automatically assume guilty until proven innocent, could the locked account be for the refund? Was it actually just an unwanted returned item or was it a refund for a non-delivered/not received/damaged item or disputed.

$405 is high gift card amount. Was the refunded item paid by gift card to begin with? If so, what was the source of such high amount of a gift card? If not, why was the refund not refunded to the original method of payment (credit card, etc)? What is the source of such a high gift card (where/how did you get it)? Does Amazon think the source of the large gift card is suspicious?

The answers to these questions and info about any other unusual behavior having to do with the account (did you ever have unreceived items that you had to have reshipped?) could help the forums determine a course of action to help you.

I suggest we suspend this case until the LW can clearly explain how and where the Amazon balance came from. The last thing we want is to aid a scam.

Amazon kept referring to "linked to other accounts or related accts" so to be clear you stated you have only had one account. Correct? You've never had any other accounts. Are you a vender or was this gift card the result of a purchase that was refunded.

Possibly other family members or someone living at the same address as you has had issues with Amazon.

I am a regular Amazon user and when I had an order problem they refunded what was due me to the credit card I have on file. So to have a $400+ balance on an Amazon gift card is rather unusual. I do currently have $12 credit IN my Amazon account because of a digital book settlement but as a regular user the reason for such a large Gift Card balance is what has us stumped.

As to related accounts, a family member, son with same name (Jr), issues with deliveries to same address? A business you own and the account was in your business name and now this account is in your personal name? How long was this account open before it was closed?

Just trying to think of possibilities for what has happened?

Thank you for coming back and providing the email chain of correspondence and I can certainly see your frustration and your attempt to remain polite.

Wow, so now you can gamble online, get paid in Amazon gift cards, and the purchase something on Amazon and (possibly) ask for a refund and get cash back? I'm not saying OP did this, I'm just always shocked at how clever organizations can be with stuff like this.

    the article states
Homeland Security wants to seize a total of $159,000 spread among 15 Amazon accounts suspected to be connected to 5Dimes. All told, the accounts have held almost $1.9 million combined, the warrant application says. Amazon has shut down at least one of those accounts, the filing notes.

Dear OP - just out of curiosity, could it be possible that the 'other account' Amazon keeps referring to, the one it mentioned it closed, the one that was linked to your account, is the 5Dimes account? Did 5Dimes transfer an Amazon gift card to you? I only ask because you haven't made it clear where the gift card came from, Amazon has stated that you have had an unusually high number of returns, and, like @JVillegirl541 , when I ask for a refund on a purchase I have made via Amazon, I return the item and receive a credit in the same for in which I paid.

Might as well be direct. Clear things like this up immediately..... then we can move on to help, or not.

Used to be you can essentially pay yourself (or aliases and accomplices) with Amazon payments and local register (service like Square). The purpose usually is to create a credit card transaction that gives you miles, points or cash back.

I see no reason why Elliott's forum needs to help anyone involved in some manufactured spend scheme. We need to make sure the LWs have clean intentions.

Being someone who doesn't 'think like that' (using Amazon gift cards to get cash) I'm just always chagrinned when I read about stuff like this.

To be fair, we don't know the nature of how the gift card was obtained. Everyone has asked that of OP, now we wait for a response. The good news is that, if someone did come on here and tried to get the forums, or Chris, to advocate for them, and the situation was fraudulent, it wouldn't take long for that to be determined and the discussion to be dropped.
