I have gone to Airbnb several times. They have a policy that all payments must go thru them. If you make a payment outside Airbnb they have no leverage. Unfortunately when you have 9 guys on the way to Scottsdale and the rental agency says you must make a deposit you either do it or put the entire trip in limbo for 9 people.
Who did you make the Deposit/payment to? We have provided you with the Property mgr names and owners names above. Who did you send it too? And by check or credit card?

They have a nice front yard, paid for by stealing renters deposits! (kidding)


Hope this helps some. I wasn't able to uncover the names in that trust, unfortunately.

You may be able to at least get a judgment against the home and then put a lien on the property so that when it is sold you get paid out of the proceeds of the sale. You can even ask that the amount accrues 7% interest annually. I know it doesn't solve the 'right now' issue, but it's a thought in case you run out of other options.

That is not a gated community, you should be able to drive right up to the home. And it looks to be right off the freeway.

for the people that stumble on this post - you can always look up the owner of a property by searching on he property address in the county the property is located.

If you don't know the county, you can always just google "xyz street city, state located in county" and it will come up. then find the tax assessors website for that country and search on property address.

In this case, the rental is held in a trust but the property records contain the owners mailing address. The home associated with the mailing address is also in a trust, so no names come out of that.

At least you know where to serve them, if that is what it comes down to.

I think contact the Property Manager by phone and a Registered Letter, same to the Owner.

If you believe this is truely fraud then you need to file a Police Report.

YES I agree, file a police report for sure. In fact, do that FIRST and immediately. You can now name them in the police report and give their address.

I'm willing to bet this will be ALL you need to do to get your deposit back.

DO NOT forget to research rental/vacation law in that county/state to see if there is a deadline for returning the deposit. I say this because, when you rent in California, the owner has 21 days to return the balance of your deposit and an itemized list, with prices, of what they deducted. If the owner fails to return your deposit and/or the list by 21 days, then you are entitled to triple the amount of your original deposit, even if repairs were performed.

this is to encourage owners to be prompt, and penalize them if they are not.

My guess is that the Kern family is used to people not being able to find them to pursue them for the return of the deposit, so they persist in the behavior.
